Care Plan terms

These terms are between EMBR Consulting LTD, trading as LEDGESITES ("we") and the business that subscribes ("you"). They apply only to the LEDGESITES Care Plan: EMBR Consulting LTD's terms for its other services don't apply to it, and these terms don't apply to those services. By paying for the Care Plan, you agree to them.

  1. What you get. We build your website for free. Once you approve it and it goes live, the Care Plan costs £97 a month and covers hosting, SSL, backups, security updates, unlimited edits to your site (text, photos, prices, hours, services, pages and layout tweaks, usually within 2 working days) and support on weekdays from 9am to 5pm. A full redesign or new features aren't included; we'll always quote first and never charge without your written OK.
  2. Payment. You pay monthly in advance by card through Stripe, starting on go-live day. No VAT is charged while we're not VAT-registered. If a payment is still unpaid 14 days after it was due, we may take the site offline until it's paid. We'll give you 60 days' notice of any price change.
  3. No minimum term. Cancel any time by email, effective at the end of the month you've paid for. Part-months aren't refunded.
  4. Leaving. When you cancel you can buy the site outright for £1,497 and we'll hand over the files and help you move it. Otherwise the site goes offline at the end of your paid month. You can buy it outright at any time.
  5. Your domain is always yours. If we register it for you, it's in your name, and we'll help transfer it whenever you ask.
  6. Ownership. Your name, logo, photos and text stay yours. The site's design and code are ours until you buy it outright, and you can use them for as long as you're subscribed. We may show your site in our portfolio and add a small "Site by LEDGESITES" link in its footer, unless you ask us not to.
  7. Your part. Send us accurate content you have the right to use, and tell us about changes. You're responsible for what your site says about your business.
  8. Data. Where your site collects your customers' details (for example a contact form), you're the controller and we process them only to run your site, keep them secure, use only the providers needed to run it (hosting, form delivery), help with requests from individuals, tell you promptly about any breach, and delete or return the data when you leave.
  9. Liability. We work with reasonable care and skill, but can't promise the site will never be briefly unavailable. We're not liable for lost profits or indirect loss, and our total liability in any 12 months is capped at the fees you paid in that period. Nothing limits liability that the law doesn't allow to be limited.
  10. Ending and changes. We can end the service with 30 days' notice, or straight away for non-payment or unlawful use. If we end it for any other reason, we'll offer you the site at the buyout price. We'll give 30 days' notice of changes to these terms, and you can cancel before they apply. These terms are governed by the law of England and Wales.
  11. Referrals. Refer another business to us and, once it goes live on the Care Plan and makes its first payment, you get your next month free (one free month for each business that signs up). The free month is credited to your next payment. It has no cash value, and it isn't paid out if you cancel first.
